Ennovation Ltd is the
parent company of emacadamia.
All Ennovation
Ltd
products contain nuts or nut traces.
Prices of goods and delivery displayed on the emacadamia website are current
at the time of display. These prices are subject to variation without
notice.
We will always attempt to be as accurate as possible with our product
descriptions and pricing. However, we are unable to warrant that product
descriptions or other content of the website is accurate, complete,
reliable, current or error free.
ACCOUNTS
You may update,
edit or terminate your account at any time. You agree to maintain
and update the information as supplied by yourself to ensure accuracy at all
times.
As an emacadamia account holder, you are responsible for maintaining the
confidentiality of your own account and password. You agree to
take responsibility for all activities that occur under your emacadamia account and password.
Orders
We take payment
at the time of order, not necessarily the time of dispatch. This is to
ensure there are no last minute hitches to getting your gift delivered on
time.
No order is accepted by Ennovation Ltd until the order has been checked and
approved. If there is a problem we will e-mail you within three working
days.
Ennovation Ltd is not responsible for any loss or damage caused by late delivery
or cancellation of an order or a product.
We reserve the right not to provide goods or services, terminate accounts, remove or edit content or cancel orders at our sole discretion at
any time.

Our agreement with you only comes into existence once we have both confirmed
your order and your payment has been processed. Once we have accepted
payment for an order, cancellation of the order is within our sole
discretion. Orders that cannot be cancelled will be subject to our terms,
conditions and policies relating to Returns and Refunds.
Delivery
We will deliver the goods to you at the Delivery Address and will make every
effort to deliver within 10 working days from despatch. However, while we
make every effort to deliver within 10 working days, all dates are estimates only.
Anyone at the Delivery Address who receives the goods shall be presumed to
be authorised to receive the goods.
It is your obligation to enter the correct delivery address details at the
time of ordering. Should you enter the wrong address, we are not obliged to
re-send the order to the correct address at our expense.
It is the responsibility of the customer to inform Ennovation Ltd if an order
does not arrive. Once we learn an order has not arrived by the due date, we
will lodge enquiries with the courier/mail provider to ensure delivery
occurs as soon as possible. We will not be held liable for any loss or
damage resulting from late delivery.
You agree that when our courier/mail
provider is satisfied that the order has been
delivered, delivery of the order has taken place within the terms of the
agreement between you and us.
Without limiting the operation of any other Terms and Conditions herein, we
will not accept liability for any loss or damage arising from a late
delivery.

agree that late delivery does not constitute a failure of our agreement, and
does not entitle you to cancellation of an order.

will not accept liability for any loss or damage arising from items lost,
stolen or damaged after delivery has taken place.
Returns or Refunds
If at any time you are
not satisfied with the quality of the goods you have purchased, you may

and a representative will assess your request for a
credit or refund of the purchase price.
Please note that refunds are at the discretion of the company management.
In the event that you receive a defective or damaged product, we will refund
the original product price and delivery via the original method of payment.
Alternatively, if you request a replacement, we will dispatch your
replacement item (subject to availability) once we receive the return, at
our cost.
Please allow up to 14 days for refunds to be processed upon our receipt of
defective or damaged
goods.
Out of Stock or Substitution
In the unlikely
event that we cannot satisfy your order due to stock unavailability, we will
contact you to offer you an alternative. However, if this would prevent us
from meeting your required delivery date, we will send suitable substitutes
of the same or higher value and contact you afterwards.
User Name & Password
You agree to
take responsibility for the safekeeping of your user name and password. You
are liable if your user name and password are used by an unauthorized
person. You agree to release and indemnify Ennovation Ltd in relation to any
liability arising out of the unauthorised use of your username and/or
password.
New Zealand Law Applies
New Zealand
laws governs this agreement.
Disclaimer
The information
contained on the website is provided by Ennovation Ltd in good faith. To the
best of our knowledge, the information is accurate and current. However,
Ennovation Ltd does not make any representation or warranty as to the
accuracy or completeness of the information.
You further acknowledge and agree that Ennovation Ltd will not be liable to you
or any other person for any direct, indirect, incidental, special,
consequential or exemplary damages, including but not limited to damages for
product liability, personal injury or negligence resulting from use of goods
or services supplied to you, or on behalf of you, through the website.
Release & Indemnity
You agree to
waive any and all claims that you now have or may have in the future against
Ennovation Ltd which relate to or are incidental to any transaction.
You agree to indemnify and hold Ennovation Ltd harmless from and against any
and all claims, loss or expense that may be incurred by Ennovation Ltd which
relate to or are incidental to the performance of its duties as described in
these Terms and Conditions including all costs of defending itself against a
claim by any other person and/or as a result of you taking any action or
refraining from taking any action or instituting or defending any action or
legal proceeding.
You further agree to indemnify and hold Ennovation Ltd harmless from any
claim made by any third party due to or arising out of your use of this
website, the violation of these Terms and Conditions by you, or the
infringement by you, or other users of this website using your membership
account, of any intellectual property or other right of any person or
entity.
